Summary:                    bind init script does not detect the previous pid
Description: 
"service restart named" says that bind is not running when it is and then
starts another bind process.

Works by default unless you specify a different PID file in your
named.conf... in which case you need to tell the init.d script too (this
is normal IMO)

the issue is resolved... a combination of what was in the initscript and
what was in the named.conf was lethal. all fixed now and understood!
